1. Accepting these terms
KoiKeep is made and run by Peter Chan, an independent developer based in California, USA ("we", "us"). By downloading or using the KoiKeep mobile app or this website (together, the "Service"), you agree to these terms. If you don't agree, please don't use the Service.
2. What KoiKeep is
KoiKeep is a pond journal for koi keepers. You can log water tests and see how readings change over time, keep a record of each koi with photos, short clips, dates and notes, write journal entries, save pond photos and videos, and plan your pond care with reminders. It also includes reference material: care articles, a glossary, a koi variety catalog, and calculators for salt, pond volume and free ammonia. We may add, change or remove features as the app develops.
3. Your account
You can explore the sample pond and the reference material without an account. Saving your own ponds, koi and records needs one. You can sign up with an email address and password, or with your Google or Apple account. You're responsible for keeping your sign-in details safe and for what happens under your account.
You must be at least 13 years old to create an account. If you're under the age of majority where you live, you need a parent or guardian's permission.
4. Free trial and subscription
When you create an account you get a 14-day free trial. After the trial, KoiKeep costs $17.99 per year in the US. Prices in other countries are set by the App Store or Google Play and shown before you buy.
- Subscriptions are bought and billed through your App Store or Google Play account, not by us.
- A subscription renews automatically each year unless you cancel it at least 24 hours before the renewal date. You can cancel or manage it in your App Store or Google Play account settings.
- Deleting your KoiKeep account does not cancel your subscription. Cancel it with Apple or Google as well.
- Refunds are handled by Apple or Google under their own refund policies.
5. Acceptable use
Please use the Service fairly. In particular, you agree not to:
- use the Service for anything unlawful
- upload photos, videos or text you don't have the right to use, or that are illegal
- try to access other people's accounts or data, or our systems, without permission
- interfere with or overload the Service, or try to copy or reverse-engineer it
6. Your content
Your ponds, readings, koi records, notes, photos and videos are yours. Your records are private to your account, and other KoiKeep users can't see them. By using the Service, you give us only the limited permission we need to store your content, back it up, and show it back to you. You can delete it, and your account, at any time from within the app.
7. Our content
The KoiKeep app, its design, its code, its name and logo, and its articles and glossary belong to us and are protected by intellectual property law. The images in the built-in koi variety catalog are copyrighted by Genki Nishikigoi, Inc. and are used with their permission. You may use all of this for your own personal use of the app, but not copy or republish it.
8. A guide, not professional advice
KoiKeep is a record-keeping and learning tool. The care articles, the water-reading guidance, the "pond health" indicator, the calculators and the reminders are there to help you, but they are general information. They are not veterinary, water-treatment or professional advice, and they can't account for every pond. Always check calculator results before adding anything to your pond, follow product instructions, and ask a qualified koi vet or pond professional when your fish's health is at stake. Reminders appear in the app, so make sure you still keep track of anything critical yourself.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the extent the law allows. We don't promise that the Service will always be available, error-free, or right for your particular needs.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential losses arising from your use of the Service. This includes the loss or illness of fish or other animals, damage to your pond or equipment, and lost data. Our total liability for any claim will not exceed the amount you paid for KoiKeep in the twelve months before the claim arose. Some places don't allow these limits, so they may not all apply to you.
11. Ending your use
You can stop using KoiKeep and delete your account at any time. See the data deletion page. We may suspend or close an account that breaks these terms, and we'll give notice where we reasonably can.
12. Governing law
These terms are governed by the laws of the State of California, USA, and any disputes will be resolved in the state or federal courts located in California. This doesn't take away any rights you have under the consumer protection laws of the place where you live.
13. Changes to these terms
If we change these terms, we'll update the date at the top of this page. If the change is significant, we'll also tell you in the app. If you keep using the Service after a change takes effect, you accept the updated terms.
